New Collections Requirements



 

Effective July 1, 2021, Senate Bill 56 requires both Homeowner and Condominium Associations to send a final thirty (30) day delinquency notice to homeowners before law firms can take legal action on behalf of an Association incurring delinquent homeowner legal fees.


This notice must be sent before a file is sent to a law office for collection and must meet the following:


1. The thirty (30) notice must be sent via first class mail to the owner at their last address as reflected on the Association’s records AND must also be mailed to the property address if such address is not the property address.


2. This notice must itemize the assessment with due dates, any late fee(s) and any interest with dates, along with the interest rate charged.


Since this new law requires compliance with this notice requirement before law firm involvement in the collection process, we are now requiring that a copy of this notice be provided to us with your collection packet when opening a new file with our firm.
